ESTATE PLANNING ISSUES FOR HAWAII CLIENTS FROM COMMUNITY PROPERTY STATES

I. BACKGROUND.

FOR HAWAII CLIENTS

A. Community property is a regime of marital property that traces it roots to civil law systems.

1. Most property acquired during marriage is owned jointly by both spouses and divided equally in the event of divorce, annulment or death, no matter what the actual title of the asset may be.

2. Community property rules generally do not apply to property acquired prior to the marriage or to property acquired by gift or inheritance during the marriage.

3. Division of community property may take place by item, by splitting all items or by value. In some jurisdictions, such as California, an equal division of community property is mandated by statute. See California Family Code Sec. 2550.

4. There are 10 community property states, mostly in the west: Alaska, Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington and Wisconsin. The two most populous states, California and Texas, containing almost 20% of the U.S. population, are community property states.

Vision USA Hawaii Project - Year Round Program

Vision USA optometrists, members of the Hawaii Optometric Association, will provide basic eye health and vision care services to individuals and families, who may not qualify for government aid or private health care assistance. Eligible patients will receive a basic eye exam, and in some cases, eyeglasses without cost.

Hawaii Dolphin Swim Information:

There are numerous ways to create a dolphin encounter experience in Hawaii. Below are some suggestions based on my experience and information that has come my way.

One thing to keep in mind, though, is that when journeying to encounter dolphins in the wild, there are no guarantees. I have had experiences with both outcomes...sometimes they have appeared, and sometimes they have not. Often the times they did not appear physically have been my most profound experiences. The dolphins were definitely choreographing my experiences on land. The dolphins are masterful not only in the water, they are energy masters on land, too. Be aware of all that is occurring around you. A key learning that I have received from them is to let go of ALL expectations and attachments, and be open for the magic to unfold in any way...often it takes the most unusual forms. This is part of the adventure! It is like a treasure hunt, and the treasures are within us and all around us.

The dolphins are also encouraging us to move beyond our physical senses. They are teaching us humans to expand our extra-sensory perceptions...to move beyond what we already know. They are assisting us to move into our future. They do this in a very non-linear way. It is subtle, and very profound. It is the new way, and they are helping us attune to it by guiding us through unique life experiences.

There is a specific protocol for how to behave while swimming with dolphins. Several dolphin swim web sites have very good descriptions of what to do and what not to do.

Get approval for concurrent travel (for command-sponsored tours only).
Visit your Relocation Office and obtain information on your next duty station. Schedule a meeting with a relocation specialist at your station to plan for the move. Ask them what benefits you are entitled to (this differs depending on marital status).
Discuss specifics of your move with your Transportation Office (TO), storage, household goods and hold baggage shipments, privately owned vehicles and pet shipment. Provide your current TO with your estimated shipping weight of your hold baggage and household goods shipments.

Hawaii is not that special, it’s nice but I wouldn’t want to live here…this is what I thought many years ago after my first week of vacation.  I was going from tourist attraction to tourist attraction seeing beautiful places but I was missing something. On the second week of my vacation I stopped being a tourist, I stopped rushing around, and I took time to feel the spirit of Hawaii and I fell in love with the Islands; I gave my notice at work, left home and moved to Hawaii for an unforgettable year…and the start of my life of travel!

  I have designed this trip with time to explore, to relax and to feel the real Hawaii.  Many tours go from island to island with a lot of time spent at airports and hotel check-ins.  We will be exploring two of the most beautiful islands, with time for sight seeing and time to walk on the beach and watch the sunset. Please join me, I would love to show you the beauty of these two special islands.

Maui  - The Magic Isle.  It’s understandable how Maui has been voted “Best Island” by readers of Conde Nast Traveler for seventeen years!  Imagine beautiful beaches, lush green valleys, award winning golf courses and great restaurants and shops.

Check-in at the Sheraton Resort & Spa, located on Kaanapali Beach – you have an ocean view and private lanai. You will meet the other travelers for a Welcome Drink and Pupu’s.






Sep  06  Thu    -   Maui
Haleakala, Central Maui and Iao Valley Tour – On this full day tour you journey to the summit of Mount Haleakala - Hawaii’s House of the Sun!  You will travel through Maui’s Upcountry Kula Area to the 10,043 summit at Haleakala National Park and Pu’u Ula’ula Overlook. Experience the unique flora and birds that are part of the beauty of Maui. On the way back you will stop at Iao Valley State Park and see Iao Needle, the forth largest peak on Maui.

Enjoy the day!  Do an optional tour, take a helicopter ride or Road to Hana Excursion ; swim, snorkel, zip-line, go horse back riding, shop, play golf looking out at the ocean, or sit by the pool with an umbrella drink and a good book!

Kaua’i - The Garden Isle. With its endless shades of green, soaring cliffs and dramatic canyons, Kauai invites you to renew your connection with nature. This emerald treasure has been the setting for over 60 movies and TV shows because of its exotic beauty.

Time to leave Maui! We transfer to the airport for our flight to Kauai and check-in at the Kauai Marriott Resort, which has completed a 50 million upgrade. Enjoy the resort before we meet tonight for dinner.

Kauai Movie Adventure – on your full day tour, you’ll explore some of the most romantic, exciting and adventurous movie locations in the world as we learn the rich history of the island.  Visit many famous movie locations including South Pacific, Jurassic Park, Blue Hawaii, Donovan’s Reef, Raiders of the Lost Ark and George Clooney’s new movie The Descendants.  We stop for lunch (not included) in Hanalei on the North Shore; a small town filled with colorful shops, restaurants and unique art galleries.

Waimea Canyon Excursion – Waimea Canyon  called the Grand Canyon of the Pacific is over ten miles long, and almost 4,000 feet deep, has stunning views of  lush valleys and tropical forest canopies.  The Waimea Canyon State Park has native and introduced forests and mountain scenery, this is one of Kauai’s biggest attractions.
